1. Self-Declaration:

The team of OSIEJ MARKETING PVT. LTD. (OMPL) firmly declares that the company is compliant with the following:

The company does not promote a Pyramid Scheme, as defined in the Consumer Protection (Direct Selling) Rules, 2021. Or enroll any person in such a scheme or participate in such an arrangement in any manner whatsoever in the guise of doing Direct Selling business.

OSIEJ MARKETING PVT. LTD. also does not participate in a Money Circulation Scheme, as defined in Consumer Protection (Direct Selling) Rules, 2021. & Consumer Protection (Direct Selling) Amendment Rules , 2023." In the guise of Direct Selling of Business Opportunities.

The company is also compliant with all the remaining aspects mentioned in the Consumer Protection (Direct Selling) Rules, 2021 , & Consumer Protection (Direct Selling) Amendment Rules , 2023." by the Department of Consumers Affairs, Ministry of Consumer Affairs, Food and Public Distribution and shall also provide such details as may be notified from time to time.

2. Cancellation and Refunds Policy

If you are not satisfied with your purchase, please contact us by phone, and we will solve it immediately. Otherwise, you can proceed further to the refund policy as mentioned below.

1. Your item must be in its original unused condition to be returned, unless there is a manufacturer defect. You may request a return within 3 days of the receipt of the product.

2. For each individual order, we select a shipping method that will provide both value and speedy delivery. Standard shipping methods like Private Courier services.

Return Exceptions

If you think you have received the product in bad condition or if the packaging is tampered with or damaged before delivery, please refuse to accept the package and return it to the delivery person. We will personally ensure that a brand new replacement is issued to you with no additional cost within 7 working days. Please make sure that the original product tag and packing are intact when you send us the product back. Return duration is 10 days apart from conditions reserved herein above.

The following products shall not be eligible for return or replacement

1. Any product that exhibits physical damage to the box or to the product after receiving it from the delivery boy.

2. Any product that is returned without all original packaging, including the retail box originally included with the product at the time of delivery.

3. Additionally, any product without a valid, readable, untampered serial number, including but not limited to products with missing, damaged, altered, or otherwise unreadable serial number or batch number.


3. Buy Back / Exchange / Refund Policy

OSIEJ MARKETING PVT. LTD. Buy Back Policy for Customers / Independent Distributors:
Customers / Independent Distributors may return the products within 3 days of invoice as follows:

SECTION - A

Thanks for shopping with us. OSIEJ MARKETING PVT. LTD. stands behind the quality of its products and guarantees your satisfaction. If for any reason you are not completely satisfied with the products, you may return them within 3 days from the date of invoice of the product, which should be notified within one week from purchase as per the terms of the Refund Policy.

  1. If the product is in marketable** condition and is returned within 30 days of the invoice date accompanied by the original invoice, 5 % of the amount will be deducted towards handling charges, and the rest of the amount will be refunded.
  2. If the product is in marketable** condition and is returned within 30 days of the invoice date accompanied by the original invoice, then the refund, after deduction of GST * / Taxes levied, will be given, and handling charges will be deducted.
  3. If the product is in Unmarketable *** condition and is returned within 30 days of the invoice date, the refund value will be assessed by the returns officer, and the appropriate value will be given.

*GST (Goods & Services Tax)
**Marketable refers to products that are unopened and sealed.
***Unmarketable are products, which have been opened and seal broken.

Exchange

If you need to change the products you may need to have the original customer order receipt copy. Thereafter, the customer/independent distributor can exchange the products with the company within seven days from the date of the invoice and must submit the following at the time of exchange to help us with our services.

  • Product Return Form
  • Copy of Purchase bill
  • Products in original packing and condition
  • New product should be of equal or higher value in price
Refunds

Once we have received your item we will inspect it and notify you that we have received your returned item. We will inform you of the status of your refund. If the item. In the event that the return of a product is duly accepted by OMPL, the value of such product will be calculated as per Section A, point number. 1, 2 & 3 and will be refunded to Customer / Independent Distributor either to the bank account provided by the Customer / Independent Distributor for such refund, or to the payment instrument of the customer / Independent Distributor from which payment was made. OMPL shall have sole discretion to determine the mode of reversal from the above options. No cash refunds under any circumstances will be made.

Shipping Cost

You will be responsible for paying your own shipping cost for returning your items. Shipping costs are non-refundable. In some exceptional cases, if the cost of the shipping is paid by the shipping cost of the return product, it will be deducted from the refund amount.

Cancellation of transactions/orders:
  • Cancellation by OSIEJ MARKETING PVT. LTD.

    There may be certain orders that OMPL is unable to accept and has the right to cancel such orders. OSIEJ MARKETING PVT. LTD. reserves the right, at its sole discretion, to refuse or cancel any order for any reason whatsoever. Some situations that may result in Customer / Independent Distributor's order being canceled include, without limitation, unavailability of the product or quantities ordered. OMPL may also require additional verification or information before processing any order. If a Customer's or Independent Distributor's order is canceled after payment has been processed, the corresponding amount will be reversed or remitted to the Customer or Independent Distributor, either to the bank account provided for such reversal or payment instrument from which payment was made. OMPL shall have sole discretion to determine the mode of reversal from the above options.

  • Cancellation by the Customer / Independent Distributor:

    In the case of a request for order cancellation, OMPL reserves the right to accept or reject requests for order cancellations for any reason whatsoever. As part of its usual business practice, if OMPL receives a cancellation notice and the order has not been processed, OMPL may cancel the order and refund the entire amount to the Customer or Independent Distributor within a reasonable period of time. OMPL will not be able to cancel orders that have already been processed. Customers agree not to dispute the decision made by OMPL and accept OMPL's decision regarding the cancellation.

  • Set-off of any benefits availed by the Independent Distributors:

    In case the Independent Distributor has availed any benefit under any marketing or promotions provided by OMPL in relation to the Product for which the order has been canceled by the Independent Distributor or by OMPL, Independent Distributors agree and authorize OMPL to recover such benefits from the Independent Distributors or set off the same from any refunds to be made.

Reference Notes:
  1. The customer/Independent Distributor must return the product(s) to our head office personally or by courier.
  2. The return period for products is calculated as the number of days from the invoice date to the date of receipt at the Company Head Office.
  3. Condition refers to the state in which the stock is received back from the customer or independent distributor as a return. The product can be 'marketable' or 'unmarketable' depending on the condition of the returned stock, as assessed by the Returns executive at the Company Dispatch and Delivery office.
  4. The Product Return Policy does not apply to opened packs of literature,videos, or other sales and marketing aids.
  5. Total returns cannot exceed the quantity appearing on the Invoice.
  6. The return process for a product may be subject to additional terms depending on the nature and category of the product. Any such additional terms may be specified on the website or be intimated by the company at the time of purchase of the product.

We declare that our company is engaged in the business of direct selling through its Direct Sellers and retail outlets, as well as other business activities stated in the object clause of the Memorandum of Association of the company.

There are no deposits or charges, including enrollment fees,joining fees, or renewal charges, for becoming a direct seller of the company. If any distributor is working with the company and has a unique ID, and is involved in our field regarding the sales of the product or other promotional work on behalf of the company, any of his / her acts or omissions that constitute misconduct, professionalism, or unethical behavior and are harmful to the company, the unique ID of such distributor's unique ID being held, blocked, or delisted by the company without notice.

We also declare that we have not been given any assurance or promise by the company or its direct sellers regarding any income on account of the customer's product purchase made by the customer. However, a direct seller will be eligible for income and facilitation fees depending on the volume of business done by them, as per the terms and conditions of the company.

The shipments are in perfect condition when the carrier takes possession of the same. By signing “received” on the delivery note, the recipient(s) acknowledge that the order was received in satisfactory condition. Do not sign in the event of damages or product shortages. Hidden damages discovered after the carrier has left and all other discrepancies must be notified within twenty-four (24) hours of receipt of shipment. Failure to notify OMPL of any shipping discrepancy or damage within twenty-four (24) hours of receipt of the shipment will cancel a OMPL Independent Distributor's right to request a correction and shall be considered deemed acceptance of the products.

Orders placed are typically shipped the very next business day. Orders placed on Saturday after 2.30 pm will be shipped on the following Monday. Delivery time will vary according to the location of customers /OMPL Independent Distributors. The average delivery time is between 2 - 7 days. Delivery of products will not occur on Sundays or major holidays, as per the policy of the delivery partner.

Delivery of the Product:
  • There are various delivery models for the delivery of purchased products to customers /OMPL distributors, as decided by OMPL . The risk of any damage, loss, or deterioration of the products during the course of delivery or transit shall be on the company and not the customer / Independent Distributor. OMPL represents and warrants that the products delivered are not faulty and are exactly those products which are listed and advertised on the website, meeting purchased by the customers and independent distributors, and fulfilling all descriptions and specifications provided on the website.
  • The customer / Independent Distributor's shipping address and pin code will be verified with the database of the website before they proceed to pay for their purchase. If the order is not serviceable by logistic service providers or the delivery address is not located in an area that is covered under the order confirmation form, the customer /Independent Distributor may provide an alternate shipping address on which the product can be delivered by the logistics service provider.
  • Please note that there is no guaranteed dispatch time, and any information about dispatch should not be relied upon as such. Therefore, time is not the essence of the bipartite contract between the customer/Independent Distributor and OMPL . For purchase and sale of the product on or through the website. However, the product will not be delivered to the customer /Independent Distributor unless he / she makes the full and final payment.
  • The customer /independent distributor shall be bound to take delivery of the purchased by him / her that are said to be in a deliverable state. Where a customer or independent distributor neglects or refuses to accept the delivery of the product ordered by him or her, the customer or independent distributor may be liable to OMPL for such non-acceptance. OMPL At its own discretion, we may call the customer/independent distributor to evaluate the reason for non-acceptance of the product. The decision of OMPL Would be final and binding on whether to redeliver or process a refund as per the refund policy.
  • The title to the products and other rights and interests in the products shall pass directly to the independent distributor from OMPL Upon delivery of such product and upon full payment of the price of the product. Upon delivery, the independent distributor is deemed to have accepted the products. The risk of loss shall pass on to the independent distributor upon delivery of the product.
  • Before accepting delivery of any product, the customer/independent distributor should reasonably ensure that the product's packaging is not damaged or tampered with.
Governing Law:
  • Any dispute(s) between the independent distributor or its nominee(s) and OSIEJ MARKETING PVT. LTD. Arising from this policy shall be referred to the sole arbitrator (appointed by the company), and the same shall be adjudicated by such arbitrator as per the provisions of the Arbitration and Conciliation Act, 1996. However, all proceedings shall come within the jurisdiction of JAIPUR , RAJ. only, and such arbitration proceedings shall be held in the district courts of JAIPUR , RAJ. only. The final decision of the arbitrator would be binding upon both parties. Any breach of this covenant by the customer/independent distributor will make them liable for damages and legal costs to the company.

7. GRIEVANCE REDRESSAL / NODAL OFFICER POLICY:

The grievance redressal policy provides direct sellers, customers, C & F, and employees of OSIEJ MARKETING PVT. LTD. With a resolution process governing the complaint resolution. The purpose of this policy is to establish a process for addressing complaints and resolving them within a stipulated time frame.

The grievance officer shall be appointed by the company's board as the company's grievance redressal officer, who will hear out the grievances of concerned persons and counsel them.

The grievance redressal members will report to the grievance committee, and then the committee shall report to the nodal officer of the company.

If the concerned individual is not satisfied with the decision of the grievance redressal officer within 20 days, then they shall refer such cases to the nodal officer within 5 days. If the Nodal Officer won't be able to resolve them, the board shall investigate those matters within the next 5 days.

The Nodal Officer, will be appointed by the director of the company, will the Nodal Officer who shall hear grievances received from the grievance committee that have been pending and unresolved, and counsel them accordingly.

8. POLICY ON DE- LISTED OF DIRECT SELLER

For OSIEJ MARKETING PVT. LTD. The rules and regulations notified by the authorities in respect of direct selling shall be considered of utmost priority to follow.

A delisted direct seller means list of direct sellers maintained by a seller whose authorization has been canceled or suspended by the company's management of the company on the following grounds:

  1. Violation of the code of conduct.
  2. Fraudulent activities or sales, misleading representations, coercion, harassment, or unconscionable or unlawful means.
  3. If the direct seller charges an entry fee or subscription fee.
  4. If the direct seller was convicted or bankruptcy during the last 5 years prior to association with the business of direct selling, or being a person of unsound mind.
  5. If the direct seller is not able to deliver products to the consumer within the specific time period.
  6. if the direct seller is involved in promoting a pyramid scheme or enrolling any person to such a scheme or participating in such an arrangement in any manner whatsoever in the guise of doing direct selling business.
  7. If the direct seller participates in a money circulation scheme in the guise of doing direct selling business.
  8. If the direct seller engages in unfair trade practices as defined in consumer protection act.
  9. If the direct seller has not been operative/working in the company for the last two years.
  10. If the direct seller defames the goodwill or reputation of the company before the public, consumer, other direct sellers, or another direct selling entities.
  11. If any direct seller instigates other direct sellers against the company.
  12. If the direct seller visits a consumer's premises without an identity card and prior appointment or approval.
  13. If the direct seller provides any literature to a prospect that has not been approved by the company.
  14. If the direct seller does not complete the necessary registration as specified under the direct selling rules, 2021, and Consumer Protection (Direct Selling) (Amendment) Rules , 2023.
  15. On any other grounds as decided by the company from time to time.

Restocking Fee and Refund:

There are no restocking fees. But, we do not refund the original shipping and handling that you paid on the order, which will be deducted from your refund. Refunds will be made in the same form as the payment received within 10 working days from the date of return of the products.
